Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the SwipeVibe mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Bela Apps ("we", "us", "our"), the operator of SwipeVibe. References to "you" or "User" mean any individual who accesses or uses the Service.

2. Description of Service

SwipeVibe is a mobile application and associated website that allows users to:

• Vote on opinion questions by swiping left (No / Disagree) or right (Yes / Agree).
• View aggregate vote results in a cinematic multi-phase reveal sequence.
• Receive a dynamically assigned Personality Label (Crowd Reader, Contrarian, Balanced Mind, Rare Mind, Lone Voice, Trend Spotter) based on voting patterns.
• Earn XP points, level up (10 levels), build daily streaks, unlock achievements (25+), and compete on a global leaderboard.
• Create questions using 4 types: Hot Take, Would You Rather, Moral Dilemma, Risk vs Safe.
• Browse and explore questions by category across 10 topics.
• Share vote results via the Share Your Take feature.
• Subscribe to SwipeVibe PRO for unlimited swipes, demographic breakdowns, and advanced analytics.

The Service is currently in active development and pre-launch. Features may change, expand, or be removed as the product evolves. The Service is provided "as available" during this phase.

3. Eligibility

You must be at least 13 years old to use SwipeVibe. If you are under 18, you must have the permission of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements.

SwipeVibe is not available in jurisdictions where it is prohibited by law. By using the Service, you represent that your use does not violate any applicable laws or regulations.

4. Account Registration

To access certain features, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorised use of your account.
• Take responsibility for all activity that occurs under your account.

You may use a pseudonym as your display name. We reserve the right to remove or require you to change a display name that we deem inappropriate, misleading, or in violation of these Terms.

You may register using Google Sign-In. In that case, your Google account credentials govern authentication, and you remain responsible for maintaining the security of your Google account.

5. Acceptable Use

You agree to use SwipeVibe only for its intended purpose — sharing honest opinions and engaging with the community in good faith. You agree NOT to:

• Create multiple accounts to manipulate vote counts, leaderboard standings, or XP.
• Use bots, automated scripts, or any automated means to vote, create content, or interact with the Service.
• Create, submit, or vote on questions designed to harass, threaten, or target specific individuals.
• Submit questions containing hate speech, content that promotes violence or discrimination based on race, gender, religion, nationality, sexual orientation, disability, or other protected characteristics.
• Submit questions or content that is sexually explicit or pornographic.
• Impersonate any person, entity, or brand.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Scrape, crawl, or use automated data collection on the Service without our written consent.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to any part of the Service or its systems.
• Use the Service to send spam or unsolicited commercial communications.
• Violate any applicable local, national, or international law or regulation.

We reserve the right to remove content and suspend or permanently ban accounts that violate these rules, without prior notice and without refund of any paid subscription.

6. User-Generated Content

SwipeVibe allows you to create and submit questions ("User Content"). You retain ownership of your User Content. However, by submitting User Content, you grant Bela Apps a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and adapt your User Content within the Service (and in promotional materials for the Service) for as long as it remains in the app.

You represent and warrant that:

• You have the right to submit your User Content and grant the above licence.
• Your User Content does not infringe any third-party intellectual property rights.
• Your User Content complies with these Terms and all applicable laws.

We do not pre-screen all User Content, but we reserve the right to review, edit, or remove any content that violates these Terms or that we deem harmful, misleading, or inappropriate. We are not responsible for any User Content submitted by other users.

7. Voting Integrity

The integrity of SwipeVibe's results depends on honest, single-vote participation. To protect the community:

• Each user account may cast one vote per question.
• Vote manipulation — including using multiple accounts, bots, or coordinated inauthentic behaviour to skew results — is a material breach of these Terms.
• We use automated systems to detect and remove fraudulent votes. Manipulated results may be adjusted or the associated questions removed.
• Accounts found engaging in vote manipulation will be permanently banned.

8. SwipeVibe PRO — Subscription Terms

SwipeVibe PRO is a paid subscription tier offering additional features including unlimited daily swipes, demographic breakdowns, full vote history analytics, deep explore filters, and a PRO profile badge.

• Pricing: Subscription pricing is displayed at the time of purchase and may vary by region.
• Billing: Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: Cancel at any time through your App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period — you retain PRO access until then.
• Refunds: Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not issue direct refunds for subscription payments.
• Free tier limits: Free accounts may have a daily vote limit. These limits are subject to change.
• Changes to PRO: We may change PRO pricing or features with reasonable notice. Material feature removals will be notified at least 30 days in advance.

9. Intellectual Property

All elements of the SwipeVibe Service — including but not limited to the app design, UI/UX, animations, the 9-phase result reveal mechanic, Personality Label system, gamification architecture, sound design, logo, branding, and website — are the intellectual property of Bela Apps and are protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you a right to use any Bela Apps trademark, logo, or brand name. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Vote results are statistically representative of any population or demographic.
• Any particular feature will remain available in its current form.
• Content created by other users is accurate, lawful, or appropriate.

Vote results on SwipeVibe are for entertainment and personal reflection only. They should not be used as the basis for scientific, medical, legal, financial, or political decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BELA APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR SWIPEVIBE PRO IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) USD $10.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bela Apps and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

13. Termination

We may suspend or permanently terminate your account and access to the Service at any time and without prior notice if we believe you have violated these Terms, engaged in vote manipulation, submitted prohibited content, or for any other reason at our sole discretion.

Upon termination: your licence to use the Service ends immediately; your vote data, XP, streaks, and achievements are no longer accessible; anonymized aggregate vote data derived from your votes may be retained. You may delete your account at any time through the app settings.

You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification) will survive.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. For any dispute arising from these Terms or your use of the Service, you agree to attempt to resolve the dispute informally by contacting us at [email protected] first.

If informal resolution fails, disputes will be subject to binding arbitration or the jurisdiction of courts in accordance with applicable law in your jurisdiction. Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

15. Changes to These Terms

We may update these Terms at any time. When we make material changes, we will update the "Last updated" date, notify registered users by email, and display a prominent in-app notice. Continued use of the Service after the effective date of revised Terms constitutes your acceptance.
